Agreement to Terms

These Terms of Service (we'll just call them "Terms" for short) are the legal agreement between you and Agency Growth Potion (that's us—"we," "our," "us") when it comes to using our website and services.

Bottom line: if you use our services, you're agreeing to these terms. Don't like them? That's totally fine, but you won't be able to use what we offer.

Description of Services

What do we do? We help insurance agencies connect with people who are actually looking for insurance. We're in the lead generation business, and here's what that includes:

High-intent insurance leads delivered straight to you—email or phone, your choice
Custom growth plans that actually fit your agency
Real-time delivery, no call centers or middlemen getting in the way
Support along the way as we set things up and start delivering

Quick note: we focus on agencies that have at least $750 per month in ad spend and are serious about growing their business.

Eligibility and Account Requirements

Before you can use our services, there are a few requirements you need to meet:

You need to be 18 or older
You must be a licensed insurance agency or someone authorized to act on behalf of one
You should have at least $750 a month to spend on advertising
Give us accurate info when you sign up—no fake names or made-up businesses
Keep your account login info safe and don't share it
If someone else gets into your account, tell us right away

One more thing: whatever happens under your account is on you, even if you didn't authorize it. So keep those credentials secure.

Payment Terms

Here's how our payment model works—it's pretty straightforward:

No Upfront Payment: You don't pay a dime until everything's set up and we're actually delivering leads.
Payment After Setup: Once we've finished setting things up, created your growth plan, and started sending leads your way, that's when payment kicks in.
Pricing: We'll talk through pricing when we put together your custom plan. Everything's in U.S. dollars unless we say otherwise.
Payment Methods: We'll accept whatever payment methods we agree to in your service agreement.
Late Payments: Miss a payment deadline and we might have to pause or shut down your service. Nobody wants that, so let's avoid it.

Use of Services

Use our services legally and responsibly. That means you won't:

Break any laws—federal, state, local, or international
Ignore insurance industry rules or licensing requirements
Do anything shady, fraudulent, or misleading
Resell or share leads with people who shouldn't have them
Use bots or automated systems to access our stuff without permission
Mess with our services or servers—no hacking, DDoS attacks, or anything like that
Try to break into parts of our system you're not supposed to access

Lead Quality and Guarantees

We do our best to send you good, high-intent leads. But let's be clear about a few things:

We can't promise every lead will turn into a sale—that's not how this works
Whether someone buys depends on a lot of stuff we can't control: your sales process, how you price things, how good your customer service is, etc.
We send leads exactly as we get them—raw, unfiltered, straight to you
It's on you to reach out to leads quickly and professionally
We don't pre-screen or qualify leads before sending them your way

We aim for quality, but we can't guarantee specific conversion rates or how many sales you'll close. That part's up to you.

Intellectual Property

All the stuff on our site—the content, features, functionality, everything—belongs to us. It's protected by copyright, trademark, and other IP laws.

Don't copy it, don't modify it, don't redistribute it, and don't make your own version of it. If you want to use something, ask us first and get it in writing.

Termination

We can shut down or suspend your access anytime, for any reason, including if you break these terms. We don't have to warn you first, though we usually try to.

You can also cancel your account whenever you want—just let us know. When things end, here's what happens:

You lose access to our services right away
Any money you still owe us? That's still due
We might delete your account and all the data tied to it

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We can't promise the services will always work perfectly, never go down, or be completely bug-free. Things break sometimes. We also can't guarantee you'll get specific results—everyone's situation is different.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AGENCY GROWTH POTION, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

If something goes wrong and we're somehow liable, the most we'll ever owe you is whatever you paid us in the 12 months before the issue came up. That's our cap.

Indemnification

If you mess up—whether it's breaking these terms, using our services wrong, or infringing on someone else's rights—you're on the hook. You agree to cover us (and our affiliates) for any claims, damages, costs, or legal fees that come from your actions.

Governing Law

These terms are governed by U.S. law, regardless of conflict of law rules. If we end up in a legal dispute, it'll be handled in U.S. courts.

Changes to Terms

We might update these terms from time to time. When we make significant changes, we'll post the new version here and update the date at the top.

If you keep using our services after we've changed the terms, that means you're okay with the updates. Not happy with the changes? Then it's time to stop using what we offer.
